Mobrage Driving Academy  ·  Last updated: 10 April 2026

These Terms & Conditions govern your use of Mobrage Driving Academy's services, including in-person driving lessons and the Tacholator platform. By enrolling with Mobrage or using Tacholator, you agree to these Terms.

1. Introduction

Mobrage Driving Academy ("Mobrage", "we", "us", "our") operates both in-person driving tuition and Tacholator, a digital learning, progress-tracking, and communication app. These Terms & Conditions govern your use of Mobrage's services, including driving lessons and the Tacholator platform, as a pupil or instructor. By enrolling with Mobrage or accessing Tacholator, you agree to comply with these Terms. If you do not agree, you must not use our services.

2. Eligibility

  • All learners must provide valid identification and the required UK driving licence or learner permit before beginning any lessons.
  • Learners must meet legal age, health, and eyesight requirements as set out by the DVSA.
  • Tacholator may be used by registered pupils of Mobrage Driving Academy or instructors approved or contracted by Mobrage.
  • Use of the App requires accurate account information and compliance with applicable UK driving laws and regulations.
  • Mobrage reserves the right to refuse or discontinue training if eligibility requirements are not met.

3. Payment Policy

  • All lessons, packages, and services must be paid in advance unless an alternative written agreement is made.
  • Accepted payment methods may include credit or debit card, bank transfer, or any digital payment method approved by Mobrage.
  • Lesson packages must be used within the validity period stated at the time of purchase. Unused lessons after this period may not be refunded.
  • Lesson prices are calculated based on duration and the instructor's hourly rate at the time of booking. The rate applied at booking is fixed for that lesson.

4. Booking Lessons

  • All lessons must be booked through the Mobrage application using the Book a Lesson feature.
  • Lessons can only be booked in time slots made available by the instructor.
  • A booking is initially marked as Pending until confirmed by the instructor. A lesson is only considered confirmed once the instructor approves it.
  • Mobrage reserves the right to refuse or cancel bookings where system misuse or abuse is detected.
  • Booking times cannot be modified once confirmed; the lesson must be cancelled and rebooked. Any change is subject to availability and cancellation rules.

5. Cancellation and Rescheduling Policy

5.1 Cancellation with 48 Hours or More Notice

  • Pupils may cancel a confirmed lesson 48 hours or more before the scheduled start time.
  • No charge will be applied. Any prepaid hours or balance will remain unchanged.

5.2 Late Cancellation (Less Than 48 Hours)

  • If a pupil cancels less than 48 hours before the scheduled start time, the full lesson price will be deducted.
  • This applies whether the deduction is taken as monetary balance or prepaid lesson hours.

5.3 No-Shows

  • Failure to attend a lesson without cancelling is treated as a late cancellation.
  • The full lesson charge will be deducted.
  • If a learner is more than 15 minutes late, the lesson may be treated as a no-show.

5.4 Cancellation by the Instructor

  • Instructors may cancel lessons due to illness, vehicle issues, or unforeseen circumstances.
  • No charge will be applied to the pupil and any deducted balance will be refunded or restored.
  • Pupils will be notified promptly via the app.

6. Refund Policy

Refunds are governed by cancellation timing and lesson status. Full details are set out in Mobrage's separate Refund Policy. Key principles:

  • Cancellations with 48+ hours notice: fully refundable or hours restored.
  • Cancellations with less than 48 hours notice: no refund.
  • Instructor-cancelled lessons: full refund or hours restored automatically.
  • Unused prepaid hours may be considered for refund in exceptional circumstances, assessed case-by-case.
  • Approved refunds are typically processed within 5–10 working days.

7. Personal Hygiene, Behaviour and Fitness to Drive

  • Learners must maintain reasonable personal hygiene and appropriate attire for driving lessons.
  • Lessons will be terminated immediately if a learner is deemed unfit to drive due to illness, intoxication or drug use, aggressive or inappropriate behaviour, or poor hygiene impacting the lesson. The full lesson fee will still apply.
  • Learners must inform their instructor of any medical conditions that may affect their ability to drive safely.
  • Learners must behave respectfully towards instructors and other road users at all times.

8. Instructor and Vehicle Allocation

  • While Mobrage aims to provide continuity by assigning the same instructor and vehicle, this cannot always be guaranteed.
  • Mobrage reserves the right to change instructors or vehicles when necessary and will notify learners of changes wherever possible.
  • All training vehicles are fully insured for learner driver use.

9. Learner Responsibilities

  • Learners must present their valid provisional licence at each lesson. Failure to provide the licence may result in the lesson being cancelled and the full fee charged.
  • Learners must be on time for lessons. Late arrival may result in reduced lesson time without refund.
  • Learners must be ready at the agreed location at the scheduled lesson start time.
  • Learners must use the Mobrage app responsibly, provide accurate information, and keep login credentials secure.

10. Instructor Responsibilities

  • Instructors must enter accurate and honest training records (hours, skills, notes) into Tacholator.
  • Instructors must use the platform professionally and ethically.
  • Instructors must maintain confidentiality of pupil data.
  • Instructors must comply with DVSA and Mobrage guidelines and policies.
  • Instructors must make reasonable efforts to arrive on time; unavoidable delays will be communicated where possible.

11. Practical Driving Test

  • Mobrage cannot guarantee a pass result on the DVSA driving test. Test outcomes depend solely on learner performance and decision-making on the day.
  • Mobrage may assist with test booking but is not responsible for DVSA delays, cancellations, examiner availability, or test centre decisions.
  • Use of an Academy vehicle for the driving test is subject to instructor approval based on assessment of the learner's driving ability.

12. Purpose of Tacholator

Tacholator is designed to support driving tuition by providing:

  • Lesson scheduling and attendance tracking
  • DVSA-aligned skill assessments
  • Instructor notes and pupil reflections
  • Training hours tracking
  • Access to study materials and MCQ questions
  • Communication between instructor and pupil

The App is an educational support tool and does not replace practical driving lessons, professional judgement, or DVSA testing standards.

13. Paid Subscriptions

Tacholator may make certain features, tools, content, or services available on a paid subscription basis, including instructor subscriptions and test centre subscriptions. By purchasing or using any paid subscription, users agree to be bound by Tacholator's Subscription T&Cs in addition to these Terms. Subscription-specific matters — including pricing, billing, automatic renewal, cancellation, refunds, and access scope — are governed by the Subscription T&Cs. In the event of any inconsistency relating specifically to subscription matters, the Subscription T&Cs shall apply.

14. Test Route Content and GPS Guidance

Tacholator may provide access to test route content including route videos, mapped routes, and GPS route guidance for educational and familiarisation purposes only. Such content must not be relied upon as a guarantee of the exact route used in any practical driving test, current road conditions, or any particular outcome. Users remain solely responsible for complying with all applicable road traffic laws, the Highway Code, live road signs, and safe driving practice at all times. Use of the test route feature is also subject to Tacholator's separate Test Route T&Cs.

15. Account Security

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • If you believe your account has been compromised, notify us as soon as possible at info@mobrage.com.
  • Mobrage is not liable for any loss or damage resulting from unauthorised access caused by failure to keep login details secure.

16. Data Accuracy

Information entered into Tacholator — such as hours completed, assessments, and progress records — must be accurate and not misleading. Mobrage reserves the right to review and verify data, request clarifications, or correct obvious errors to maintain the integrity of training records.

17. Acceptable Use

You agree not to:

  • Use services for any unlawful or harmful purpose
  • Upload or share offensive, abusive, or inappropriate content
  • Attempt to access, alter, or delete data belonging to other users
  • Interfere with or disrupt the operation of Tacholator
  • Reverse-engineer or attempt to gain unauthorised access to the system
  • Misuse the booking system, which may result in account suspension

18. Intellectual Property

All content and functionality in Tacholator — including study materials, MCQs, assessments, progress tracking structures, design, and software — are owned by Mobrage Driving Academy or its licensors. Users may not copy, distribute, modify, reverse engineer, resell, or reproduce any part of the App or website without prior written permission from Mobrage.

19. Service Availability

Mobrage aims to provide reliable access to Tacholator, but does not guarantee that the App will always be available, error-free, or uninterrupted. Planned maintenance, updates, or unexpected technical issues may result in temporary unavailability.

20. Limitation of Liability

As far as permitted by law, Mobrage will not be liable for:

  • Loss of data due to external factors or device issues
  • Problems caused by poor connectivity or user error
  • Decisions or actions taken solely on the basis of App data
  • Any indirect, incidental, or consequential damages
  • Damages, injuries, or losses caused by a learner's negligent actions during or outside lesson times
  • Fines or penalties incurred by learners outside lesson times, or personal property left in the vehicle

Tacholator is a supplementary learning tool. Driving outcomes depend on practical instruction, DVSA criteria, and pupil performance. Nothing in these terms excludes liability where it cannot legally be excluded.

21. Privacy and Data Protection

Mobrage processes personal data in line with UK GDPR requirements. Information collected during registration and training is stored securely and used only for operational, administrative, and communication purposes. Data will not be shared with third parties unless required by law or with the learner's explicit consent.

22. Termination of Use

Mobrage may suspend or terminate access to Tacholator if:

  • These Terms are breached
  • Misuse, fraud or abusive behaviour is detected
  • A pupil or instructor relationship with Mobrage ends
  • Payment is not received

Users may request account deletion by contacting info@mobrage.com, subject to applicable data retention obligations.

23. Changes to These Terms

Mobrage may update these Terms & Conditions from time to time. Any changes will be made available within the App and/or on our website. By continuing to use Mobrage services after changes take effect, you are deemed to accept the updated Terms.
